Specsavers Remote Care: Terms of Use – important legal information

Thank you for visiting our Remote Care website or calling our Remote Care centre. By accessing and/or using our Website or using our Remote Care service, you indicate that you accept these Terms of Use (“Terms”) and that you agree to abide by them. If you do not agree to these Terms, please refrain from using our Website or Remote Care centre.

Information About Us

The services offered by this Website and Remote Care centre may be offered by any of Specsavers Optical Group Limited (registered in Guernsey with company number 12294), its subsidiaries, its holding company and its subsidiaries (“Specsavers Group”).

1 – The Service and your responsibilities

The service is interactive between you and a Specsavers Optican/Audiologist (“Specsavers Professional”) during which you may ask the Specsavers Professional questions about your optical and/or hearing health and the Specsavers Professional may provide healthcare advice based on the information you provide during the consultation and which is contained in your healthcare record. 

Important information for optical customers whose prescription has expired or is about to expire. If you are an existing Specsavers customer we will be able to access your prescription however, if you are not an existing Specsavers customer we will need to see your prescription.  If this is not available, we may have to contact your existing optician to ask for your current prescription (in which case your optician will require your consent to release this to Specsavers).  If a prescription cannot be provided we will not be able to issue a new prescription or extend your existing one.  The Specsavers Professional will discuss this with you during the consultation as required.

2. Your responsibilities

In using the Service you agree to the following:

  • You are responsible for the accuracy of the information you provide about yourself including, responses to questions asked by the Specsavers Professional and details about your prescription, audiogram, optical/audiological consultations and history and details about your general health and lifestyle;
  • You will follow the reasonable instructions of the Specsavers Professional;

2 - Specsavers privacy policy

We process personal information about you in accordance with our Privacy Policy.   By using the Service, you consent to such processing and you warrant that all personal information provided by you is accurate. Please read our Privacy Policy carefully to understand our use and treatment of your personal information.  

3 – Buying products from Specsavers – online or ordering through our Contact Centre

If you wish to purchase any optical products (e.g. glasses, sunglasses, contact lenses, cleaning products, etc) or hearing products (e.g. batteries, cleaning products, etc) please note that our “Terms and Conditions of Purchase” will apply. 

4 – Charges for services

For the standard Remote Care you will not be charged however, in the event that your existing contact lens prescription has expired or is near to expiry the Specsavers Professional can carry out remote testing in order that the Specsavers Professional may issue an extension to or renew your prescription for which there will be a charge of €15 if you aren’t an EasyCare customer. In more complex cases where the clinician needs to do a more thorough investigation – we may have to arrange an appointment to come into a Specsavers Store for which there will be a charge of €10 if you aren’t an EasyCare customer.

In the event there is a charge for the issue or renewal of a prescription we will process this payment during the remote consultation in accordance with our Privacy Policy.

The Specsavers Professional will discuss with you whether there is any charge for the Services. 

At any time prior to the Specsavers Professional issuing an extended or new prescription you are free to change your mind without any charge.  However, once the Specsavers Professional has issued this extended or new prescription no refund can be issued for the services provided even if any cancellation period is still running.

Should you require a copy of your prescription the Specsavers Professional can provide this free of charge.

5 - Disclaimers and limitations of liability

Specsavers does not limit or restrict its liability for fraud or fraudulent misrepresentation, death or personal injury should it arise from the negligence of Specsavers, its directors, employees, affiliates, or other representatives for any matter for which it would be illegal for us to exclude or attempt to exclude our liability.  We are responsible to you for foreseeable loss or damage caused by Specsavers Group from a failure by a Specsavers Professional to exercise reasonable skill and care.  We are not responsible for any loss or damage which is not foreseeable or for any failures or delays caused by you.  Loss or damage is foreseeable if either it is obvious it will happen or, if at the time services are supplied, both the Specsavers Professional and you knew it might happen (e.g. it was discussed during the consultation)

The Website is intended for use within the United Kingdom and the Republic of Ireland. Those who choose to access this site outside of the United Kingdom or the Republic of Ireland are responsible for compliance with local laws to the extent that local laws are applicable.

6 - General information

These Terms (including the guides and rules referred to herein) constitute the entire agreement between you and Specsavers and govern your use of the Website, superseding any prior agreements between you and Specsavers. The Terms and the relationship between you and Specsavers shall be governed by the laws of England. You and Specsavers agree to submit to the exclusive jurisdiction of the English courts. Any failure by Specsavers to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.

7- Jurisdiction and applicable law

These Terms shall be construed in accordance with English law. Any dispute arising from or related to the Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
